By now, most people are well aware of the drinking water crisis that emerged in Flint, Michigan when residents were exposed to high lead levels due to corrosion and leaching. Litigation and resolution of the problems have been ongoing and expensive.

Historically, most fines for contaminated water issues have been levied against community water services (CWSs) rather than industry, but given the additional scrutiny by federal and state agencies after events like the Flint water crisis and recent amendments to Toxic Substances Control Act (TSCA), private companies now need to develop strategies to address potential contaminated water exposures.

If your organization uses chemicals, especially suspected carcinogens, you will need to look closely at the impact of those chemicals on groundwater particularly groundwater that is a source of drinking water and the discharges from your facilities. David J. Scriven-Young is a senior counsel primarily in the Environmental Law, Construction, and Commercial Litigation Practices at Peckar & Abramson. Mr. Scriven-Young’s environmental expertise includes handling Superfund cases and wrongful death, personal injury, and property damage claims arising out of underground storage tank leaks, spills of chlorinated solvents, and other chemical releases.

He has represented clients before the Environmental Protection Agency and state environmental agencies in enforcement matters, and has counseled clients on compliance and/or permitting issues under the Clean Air Act, Clean Water Act, Emergency Planning and Community Right-to-Know Act, Resource Conservation and Recovery Act, and Toxic Substances Control Act.
