Workers who take unnecessary safety risks by not following established safety procedures and practices can create a host of problems for your company—including putting themselves and others in danger and creating legal liabilities and penalty risks for your company.

If your safety program lacks a strong enforcement component, there is a high likelihood that overall safety results such as accident frequency, workers’ compensation costs, and employee morale will trend the wrong way. Additionally, when it comes time to demonstrate to OSHA that your organization has implemented a comprehensive, successful safety program, you must be able to show that you have a documented disciplinary program. Without this component, serious compliance issues may occur and lead to violations, citations, and penalties, and the possibility of using the “unpreventable employee misconduct/isolated incident” defense against citations which may be available when an accident was the result of an employee’s unsafe act is unlikely.

To remedy this problem, safety managers must create, communicate, and follow a program for enforcing safety rules, observing employees’ safety related behavior, and evaluating performance. Additionally, having a clearly worded, written disciplinary policy is critical for addressing potential OSHA fines later down the road.
