When it comes to proper underground storage tank compliance, knowing which federal agency has jurisdiction over your USTs isn’t always a cut-and-dry answer.

The EPA and DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) regulations for USTs are complex and difficult to put into practice. The determining factor of whether EPA or DOT/PHMSA regulations govern a UST’s operations is the tank’s purpose, which means it’s vital for EHS managers to understand how tank usage dictates federal compliance obligations.

For example: If a UST is not used for transportation related reasons, it will generally be regulated under the EPA’s spill prevention, control, and countermeasure (SPCC) rules, federal UST rules, and if applicable, state UST regulations. If a UST is part of a transportation-related onshore facility, it will generally be regulated by PHMSA. However, there are cases when both the EPA and the DOT/PHMSA rules apply, which can create confusion and lead to issues of noncompliance and costly fines.
