Controlling hazardous energy through lockout/tagout (LOTO) is a high priority for OSHA, especially given LOTO’s consistent placement on the federal agency’s annual top 10 list of most cited violations. The numbers don’t lie, in 2016 the most popular violations included deficient energy control procedures (644 violations) and incomplete or outdated programs (440 violations).

There are a few instances where exceptions to the prescribed LOTO procedures will apply, but only if appropriate alternative protective measures (APM) are implemented.

To use APMs, you must meet specific criteria concerning when the servicing activity occurs, the nature of the service, and the installation of alternative protections. For instance, you might be able to take advantage of what’s commonly referred to as the “minor servicing exception” (OSHA CFR 1910.147(a)(2)(ii)(B).

The first step towards understanding whether you meet the established criteria is to perform an energy hazard risk assessment to ensure that all potential hazardous energy sources have been identified and addressed. If you meet the criteria and have addressed all concerns, then APMs may be to your advantage.

She represents employers and contractors nationwide in OSHA and MSHA litigation, and she provides safety and health training, auditing, and consultation services. Ms. Abrams is a Certified Mine Safety Professional, and a Department of Labor–approved trainer. She is on the adjunct faculty of Catholic University in Washington, DC, where she teaches employment and labor law.

Ms. Abrams is also a professional member of the American Society of Safety Engineers, and is co-author of several safety-related textbooks. She is chair of the National Safety Council’s Business & Industry Division committee on regulatory and legal affairs. She is admitted to the Bars of Maryland, the District of Columbia, and Pennsylvania, as well as multiple federal courts including the US Supreme Court.
