Basics of USERRA, FMLA, And The NDAA
The Uniformed Services Employment and Reemployment Rights Act (USERRA) provides specific requirements for employees who are also members of the armed forces.

Though many of USERRA’s rules are straightforward, there are current issues regarding USERRA compliance arising over workplace scheduling, particularly when National Guard and Military Reservists must fulfill their “drill weekends” and annual training obligations.

Also, in many instances, conflicts arise due to the frequency of military duty assignments, the lack of notice given to employers by service members, and the impacts to employers as a result of the service member’s absence while on military leave.

Additional employer compliance obligations are required under the National Defense Authorization Act (NDAA). Many HR professionals are still confused about how to handle military leaves appropriately to comply with this new law. For instance:
  • What is a qualifying exigency?
  • How much time can an employee take off from work if her spouse is injured in combat?
  • How do I code the time off, is it FMLA time?
  • What about having the employee use his/her vacation time, don’t they have to use that first????
